Fantasy Sports(Cricket and Football) - The Bombay High Court vide its judgment in the case of Gurdeep Singh Sachar v. Union of India and others dated 30 April 2019, citing previous judicial pronouncements of the Supreme Court and other High Courts, has upheld the legality of online fantasy sports gaming in India and has ruled that such games are preponderantly a game of skill.The Court also held that ‘the element of skill’ had a predominant influence on the outcome of the Fantasy sports game, which follows the following format:Participants have to choose a team consisting of at least the same no. of players as playing in a real-life sports team (e.g. 5 in basketball, 7 in kabaddi and 11 in cricket/football)
On this basis, the Court adjudged that playing fantasy sports constitutes a ‘game of mere skill’, which makes the Fantasy sports game exempt from the provisions of the Public Gambling Act, 1867 (PGA).
